Acceptance of Terms

By downloading, installing, or using NeverStop ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Description of Service

NeverStop is a mobile workout timer application that provides audio-guided timing for BPM-based workouts and Tabata interval training. The App is designed to help users maintain workout rhythm without needing to look at their device screen.

Free Tier

The App includes a free tier that allows users to complete up to 30 workouts at no cost. This limit is based on the total number of successfully completed workout sessions, not calendar time. Once you reach 30 completed workouts, you will need to purchase the Pro upgrade to continue using the App.

Pro Lifetime Purchase

NeverStop offers a one-time "Lifetime" purchase that unlocks unlimited workout sessions forever. Key terms:

• This is a single, non-recurring payment
• Once purchased, you have permanent access to unlimited workouts
• The purchase is tied to your Apple ID or Google account
• You can restore your purchase on any device using the same store account

Payment and Refunds

All purchases are processed through Apple's App Store or Google Play Store. We do not directly handle any payment transactions. Refund requests must be directed to Apple or Google according to their respective refund policies. We cannot process refunds directly.

User Responsibilities

When using NeverStop, you agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or create derivative works from the App
• Not attempt to bypass any usage restrictions or security measures
• Take responsibility for your own safety during workouts

Health and Fitness Disclaimer

NeverStop is a timer tool, not a medical or fitness advice service. The App does not provide health, fitness, or medical recommendations. You should consult with a qualified healthcare professional before beginning any exercise program.

We make no guarantees regarding fitness results, weight loss, muscle gain, or any other physical outcome from using the App. Your results depend entirely on your own actions, exercise form, nutrition, and individual physical condition.

Limitation of Liability

To the maximum extent permitted by applicable law, NeverStop and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or physical harm during workouts
• Loss of data stored on your device
• Any damages arising from your use or inability to use the App
• Any errors, bugs, or interruptions in the App's functionality

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice. We may also update these Terms of Service periodically. Continued use of the App after changes constitutes acceptance of the updated terms.

Intellectual Property

All content, features, and functionality of NeverStop—including but not limited to text, graphics, logos, audio files, and software—are the exclusive property of NeverStop and are protected by copyright, trademark, and other intellectual property laws.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
